1. Account Terms
You must be 18 years or older or at least the age of majority in the jurisdiction where you reside or from which you use this Service.
You must provide your full name, a valid email address, and any other information needed to complete the signup process.
You acknowledge that Equitable Mediation Services, LLC (“EMS”, the “Company” ) will use the email address you provide as the primary method for communication.
You acknowledge that EMS uses EzyCourse (“EzyCourse”) to provide us with the online course creation platform (the “Service”) that allows us to sell our product/services (the “Course” or “Courses”) to you.
You are responsible for keeping your password secure. EMS cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.
A breach or violation of any term in the Terms of Service, as determined in the sole discretion of EMS, will result in an immediate termination of your services and NO REFUND will be provided.
2. Account Activation
The person signing up for a Course will be the contracting party (“Account Owner”) for the purposes of our Terms of Service and will be the person who is authorized to use any corresponding account we may provide to the Account Owner in connection with the Course.
You agree as the Account Owner, to not share your username or password with anyone else. Doing so will result in an immediate termination of your account, and possible legal action taken by EMS against You.
3. General Conditions
You must read, agree with, and accept all terms and conditions contained in this User Agreement and the Privacy Policy before you may register for a Course.
Technical support is only provided to paying Account Owners and is only available via email.
You may not use the Service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws) as well as the laws of United State and the State of California.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of, use of, or access to the Course and / or the Service.

You understand that Course Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit Card information is always encrypted during transfer over networks.

4. EMS Rights
We reserve the right to modify or terminate the Course for any reason, without notice at any time.
We reserve the right to refuse service to anyone for any reason at any time.
We may choose to remove Course Content that we determine, in our sole discretion, is unlawful, or otherwise objectionable, or violates any party’s intellectual property or these Terms of Service.
Verbal or written abuse of any kind (including threats of abuse or retribution) directed toward any EMS employee, will result in immediate account termination.
In the event of a dispute regarding account ownership, we reserve the right to request documentation to determine or confirm account ownership. Documentation may include, but is not limited to, a scanned copy of your receipt, a government issued photo ID, and / or the last four digits of the credit card used to purchase the Course, etc.
5. Limitation of Liability
You expressly understand and agree that:
a) Nothing contained in our Courses is intended as, or should be construed by you, as legal advice, financial advice, emotional advice, or counsel.
b) We are not attorneys and do not (1) engage in the practice of law; (2) represent either of you; (3) give either of you legal advice; (4) draft legal documents, court forms, or pleadings; (5) file documents with the courts; (6) provide opinions on the law; or (7) analyze how the law might be applied to your situation.
c) The content contained in the Courses may or may not reflect the most recent developments regarding divorce issues in every state.
d) The content has been developed solely for residents of the United States of America, and may not apply to you, should you not reside in the USA.
e) Should you have any questions regarding any materials contained in the Courses, you should seek the guidance of a qualified professional in the state in which you live.
In no event shall EMS or our suppliers be liable for any special, incidental, or consequential damages arising out of, or in connection with, our Courses, the Service, or this agreement (however arising including negligence). You agree to indemnify and hold us and (as applicable) our EzyCourse partners, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis without any warranty or condition, express, implied or statutory.
EMS does not warrant that the Service will be uninterrupted, timely, secure, or error-free.
In no event will EMS aggregate liability for all claims of any kind, including any claims arising out of or related to this agreement, whether by statute, contract, tort, or under any other theory of liability, exceed the fees paid by you for the Course.
6. Waiver and Complete Agreement
The failure of EMS to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and EMS and govern your use of the Service, superseding any prior agreements between you and EMS (including, but not limited to, any prior versions of the Terms of Service).
7. EMS Intellectual Property
You agree that the Courses, and all content contained within them, are the property of EMS, including all copyrights, trademarks, trade secrets, patents, and other intellectual property ("Company IP").
You agree that the Company owns all right, title, and interest in and to the Company IP and that You will not use the Company IP for any unlawful or infringing purpose.
You agree not to reproduce or distribute the Company IP in any way, including electronically, or via registration of any new trademarks, trade names, service marks or Uniform Resource Locators (URLs).
8. Cancellation, Termination, and Refunds
THERE SHALL BE NO REFUNDS OF ANY FUNDS PAID BY YOU TO US.
You may cancel your account at any time by emailing [email protected].
Once cancellation is confirmed, your registration information will be immediately deleted from the Service. Since deletion of all data is final, please be sure that you do in fact want to cancel your account before doing so.
We reserve the right to modify or terminate the Courses for any reason, without notice at any time.
Fraud: Without limiting any other remedies, EMS may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance, or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Service.
9. Modifications to the Courses and Prices
Prices for our Courses are subject to change with no notice required to be given by us, to you.
EMS reserves the right at any time to time to modify or discontinue, the Courses (or any part thereof) with or without notice.
EMS shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Courses or Service.
10. Governing Law
This Agreement shall be governed in all respects by the laws of the State of California, San Diego County, in The United States of America.
